These Terms of Use ("Terms") govern your access to and use of the website https://newlifehospitalpharmacy.in ("Website"), operated by Newlife Hospital Pharmacy ("we", "us"). By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Website.
2. Nature of the service
Newlife Hospital Pharmacy is a curated affiliate catalogue of FSSAI-notified nutraceuticals and food-for-special-dietary-use products. The Website is not a pharmacy in the regulatory sense of the Drugs and Cosmetics Act, 1940, and we do not sell prescription medicines. When you submit an order, the order is forwarded to the manufacturer's authorised India distribution chain, which is responsible for order confirmation, fulfilment, and shipping. We act as a marketing intermediary under Section 79 of the Information Technology Act, 2000.
3. No medical advice
Content on this Website is for informational purposes only and does not constitute medical consultation, diagnosis, treatment, or prescription. The products listed are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease. Before starting any new supplement — especially if you are pregnant, breastfeeding, on prescription medication, scheduled for surgery, or managing a chronic condition — please consult a registered medical practitioner.
4. Eligibility
By using the Website you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. The Website is intended for users in India.
5. Account and registration
You may use the Website to place orders without registering an account. When you submit an order form, you warrant that the information you provide (name, phone number, delivery address) is true, accurate, and complete. You are responsible for the consequences of providing inaccurate information.
6. Order, pricing and payment
- Prices on the Website are quoted in Indian Rupees (INR / ₹) and include applicable GST.
- Prices are subject to change without notice; the price applicable to your order is the price displayed at the time the order is confirmed by phone.
- Cash on Delivery (COD) is available pan-India, with no COD fee for orders above ₹999.
- Online prepaid orders are processed via licensed Indian payment gateways. Prepaid orders typically receive a 2% discount, applied at checkout.
- An order is treated as accepted only after our customer-support team confirms it by phone.
7. Shipping, delivery and Cash on Delivery
Delivery timelines, courier partners, and COD procedures are described in our Shipping Policy. Risk in the goods passes to you on delivery. If the package is visibly damaged at the time of delivery, please refuse delivery and contact us immediately.
8. Returns and refunds
Returns and refunds are governed by our Returns Policy, which is consistent with the Consumer Protection (E-Commerce) Rules, 2020. Sealed, unopened products can be returned within 14 days. Opened or partially used products cannot be returned, in line with FSSAI hygiene requirements for nutraceutical products.
9. Intellectual property
All content on the Website — text, images, logos, design, layout, expert review notes, and structured product data — is owned by Newlife Hospital Pharmacy or licensed to us, and is protected by the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Brand names of listed products belong to their respective owners, used here for descriptive purposes.
10. User conduct
You agree not to:
- Use the Website for any unlawful purpose or in violation of any applicable Indian law.
- Submit false, misleading, or fraudulent information.
- Use automated scripts, scrapers, or bots to access the Website except for permitted search-engine indexing.
- Attempt to gain unauthorised access to any part of the Website or its underlying systems.
- Upload or transmit any content that contains malware, viruses, or harmful code.
- Resell or commercially exploit any content from the Website without our prior written consent.

We do not control and are not responsible for the content, privacy practices, or accuracy of third-party websites. Accessing third-party websites is at your own risk.
14. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, civil disturbances, acts of government, courier network disruptions, or telecommunication failures.
15. Governing law and dispute resolution
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through our Grievance Officer (see Privacy Policy). If not resolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts at New Delhi. You may also approach the consumer forum constituted under the Consumer Protection Act, 2019.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
